Privacy information

The present information is rendered by NGM S.r.l., with legal situs in Via L. Da Vinci, 7 – 56020 S. Maria (PI), in the quality of Owner of Handling, and outlines the modalities of collection and the use of the personal details of the customer by the technological partner UpCommerce S.p.a., with legal situs in Foggia via di Motta della Regina 6, in the quality of Person in charge of Data control, according to the Italian law and in particular the D.lgs n. 196/2003 (Privacy code).
Any treatment of personal data whether by the owner NGM ITALY S.r.l or by the appointed UpCommerce S.p.a will be carried out according to principles of necessity, correctness, legitimacy, proportionality and transparency. Where necessary, in relation to any specific use or treatment of the Personal Data, the consent of the user will be requested in advance.

a) Purpose and modalities of Data control

Personal details are required for the following purposes:

  1. management of the services selected by the user on the present website;
  2. promotional messages, market research, economical/statistical analysis, prize draws, customer satisfaction surveys. They may also be used for marketing activities or commercial information to reward or encourage customers following their consequent purchases through the sending of advertising fliers and promotional material in the form of fliers, e-mail, sms, mms or newsletters.

b. The conferment of data, with reference to the purposes mentioned in paragraph a1), is obligatory and a refusal to answer involves the impossibility of NGM Italia s.r.l. to provide the related services. The conferment of the data referred to in paragraph a2) is optional. c. For the purposes outlined in point a2), the data that is strictly necessary for each type of treatment may be communicated from NGM Italia s.r.l. between its own divisions and to group companies. d. The data that are strictly necessary for the processing can be communicated to the technological and instrumental partner on which the proprietor relies on for the provision of the requested service.

All data is collected by the technological partner UpCommerce S.p.a., nominated by NGM Italia S.r.l as Appointed Data Controller. The handling of the Data is effected by use of manual and computerized instruments, by NGM Italy s.r.l or byUpCommerce S.p.a. In any case, handling of data is performed in a strictly related way to the above mentioned purposes and, in any case, so as to ensure the safety and confidentiality of data, which will be managed and protected in environments to which access is under constant control.

The customer care service will be performed by both the Owner of Handling, NGM Italia S.r.l. and the technological partner UpCommerce S.p.a. Persons in charge of handling. The handling may take place by means of manual processing or electronic instruments.

Social buttons and widgets
On the Ngm Store site you can find also social buttons/widgets, or more specifically "buttons" representing social network icons (for example Face book and Twitter). These "buttons" consent the user navigating the website to visit and interact directly with social networks with just a "click". As a result of clicking on the social buttons/widgets, the social network acquires the relative data from the visit of the user no the Ngm Store site. Aside from these cases, in which the customer spontaneously shares their own navigation data with the selected social networks,UpCommerce does not share or diffuse any navigation information or data of the user.

Authentication via social networks. Some services supplied by Ngm Store use plug-ins that allow the user to identify themselves with the credentials of the social network and to access the services of the portal.
In such cases, the user should also refer to the privacy information provided by the individual social networks.

b) Nature of the assignment of data and the consequences of an eventual refusal to respond
The assignment of the personal data of the customer as well as their consent, where requested, for the handling of the same for the aforementioned purposes are strictly necessary for the execution of the activities indicated above. In cases of refusal to provide the requested personal details and/or to give the aforementioned consent, the activities listed above will not be able to be carried out.

c)Limits of communication of personal data
The personal data of the customer may be communicated to responsible subjects nominated In charge of handling, and/or persons appointed, of which a complete directory is available from the legal situs of the Owner.
Prior to gaining the express consent, the data of the customer may be yielded to third party subjects for activities similar or related to those mentioned above.

d) Cookies
The use of c.d session cookies (that are not memorized in a consistent manner on the computer of the customer and disapear with the closing of the browser) isclosely limited to the transmission of session identifiers (composed of random numbers generated by the server) necessary in order to allowthe secure and efficient exploration of the site and its applications.
The c.d session cookies used on the Ngm Store site avoid recourse to other potentially detrimental information technology procedures for theconfidentiality of navigation of the customer and does not allow the acquisition of the personal data of the customer.
The Ngm Store site uses certain systems that analyze the navigation of the customer in order to produce statistics on the visits or in order to improvethe contents on offer, to show analogous products and to place focused advertising on the web pages. The system used for creating statistics is Google Analytics, a web-analysis service provided by Google, Inc. ("Google"). Google Analytics, like other systems, uses "cookies", which are text files which are deposited on the computer of the user in order to allow the website to analyse how users utilize the site. The information generated by the cookie on the utilization of the website on the part of the the user (including the IP address) are transmitted to and deposited in the server of Google in the United States. Google uses this information with the objective of tracing and examining the utilization of the web site, to compile reports on the activity of the website and to provide other services relating to the use of the Internet. Google also has the ability to transfer this information to third parties in situations where it is imposed by the law the law or where such third parties handle the aforesaid information on behalf of Google. Google will not associate the IP address of the user to any other data in its possession. The user can in any case refuse to use cookies by selecting the appropriate settings on their browser, but by doing so may inhibit the full functioning of the website. By utilizing the Ngm Store site, the user consents to the handling of data by Google for the purposes indicated above.

In any case it is possible to adjust the internet browser software in such a way to not accept cookies, thus activating the so-called anonymous browsing, and in such case no data will be handled via these systems.

Permanent Cookies
Permanent cookies remain on the device even after exiting from the internet site until eliminated by the user or until they reach their expiry date. The Ngm Store site creates this kind of cookie and memorizes them on the device in order to be able to read them when the user visits the site again. This allows,for example the possibility to relocate, even during successive visits to the site, the selected preferences ( eg. wish list)

Promotional or targeting cookies
Promotional cookies are used to gather information on the navigation habits of the user with the purpose of proposing advertisements as relevant as possible to the users interests. This means that they are also used to limit the number of times in which the user visualizes a particular advert: for Ngm Store this signifies the ability to communicate in a more efficient way, for the user it signifies the receipt of less invasive adverts, and those closer in match to their preferences. Ngm Store also uses other cookies, of their own property or of third parties (promotional or targeting cookies) to improve the general user experience on its site. These cookies are managed by third parties, namely Criteo and Add This. The user can always disable cookies on their browser bu following the instructions provided above.

e) Rights referring to article 7 of the Privacy code
In accordance with article 7 of the Privacy code, the customer will be able to exercise their own rights, listed below.

1. The Interested Party is entitled to receive confirmation as to the existence of his/her personal information, even if not yet recorded, and the communication of this information in a comprehensible form.

2. The Interested Party has the right to obtain the indications to:

a. the source of the personal data;

b. handling modalities and purpose;

c. the logic applied in cases of handling via the use of electronic tools;

d. identification details of the owner, persons in charge and the designated representatives as according to article 5, comma 2;

e. the subjects or the categories of subjects to which the personal data may be communicated or that can come to the knowledge in the quality of designated representatives within the territory of the State, persons responsible or persons in charge.

3. The Interested Party has the right to obtain:

a. updating, rectification or, when interested, integration of data;

b. the erasing, transformation into anonymous form or blocking of data processed unlawfully, including data for which being kept is not required related to the purposes for which the data were collected or subsequently processed;

c. certification that the operations in letters a) and b) have been notified, as far as their contents is concerned, to those to whom the data were communicated or distributed, unless this requirement is impossible or involves the use of instruments manifestly disproportionate to the protected right.

4. The Interested Party has the right to oppose, in whole or in part:

a. To the personal data processing, for legitimate reasons, even though they might be pertinent to the purpose of collection;

b. To the personal data processing, for the purposes of advertised or direct sales or for market research or commercial communication.

With the purpose to guarantee the safety and confidentiality of the personal data handled, the customer will be obliged to prove their identity in order to exercise their rights to access, modification, cancellation, opposition of their personal data.
